Easee UK Flex Demand Services Terms and conditions (applies for UK users only)
1. General
EASEE DEVELOPS, MANUFACTURES, AND SUPPLIES HARDWARE FOR CHARGING ELECTRIC VEHICLES AND SMART POWER MANAGEMENT AS WELL AS SOFTWARE, CLOUD SERVICES, APPLICATION PROGRAMMING INTERFACES (APIs) AND OTHER SERVICES RELATED TO THIS. EASEE SELLS ITS PRODUCTS AND SERVICES TO PARTNERS AND INSTALLERS, WHO IN TURN ACT AS RESELLERS OF THE PRODUCTS AND SERVICES. EASEE OWNS THE INTELLECTUAL PROPERTY RIGHTS TO THE PRODUCTS AND SERVICES THAT ARE MADE AVAILABLE TO CUSTOMERS FOR FREE OR WITH A FEE.
This clause applies to users of the Easee UK Flexibility Demand Services offered through the Easee App.
Easee Products and Services are provided by Easee Energy Services AS (Organization Number: 932 789 698). Easee Energy Services AS is a member of the Easee Group, which comprises several affiliated companies (collectively referred to as ‘Easee’)
2. Easee UK Flex Demand Services
2.1 Scope
Participation in the Flex Demand Services is voluntary. You may withdraw your consent to participate at any time, and Easee will effectuate your withdrawal as quickly as reasonably possible.
2.2 Service Operation
When you are using the Flex Demand Services, Easee will monitor and manage the power consumption of your Easee device(s) connected to the Easee App. This is done to help balance the power grid by optimising the utilisation of available electricity. Specifically, you accept that the charging of your Easee device(s) may be automatically paused for shorter periods and will automatically resume.
Easee will, as part of the Flex Demand Services, enter into agreements with third parties that will provide grid owners with a right to reduce or stop the availability of electricity to your Easee devices. To the extent applicable, you authorise Easee and its nominees to make such commitments on your behalf.
2.3 Service Changes and Termination
You recognise that the Flex Demand Services are subject to change. You will be informed about any changes that materially impact your rights or obligations. Easee can at any time terminate the Flex Demand Services at its own discretion. Easee shall not be liable to you for variations of power supply that result from your participation in the Flex Demand Services.
2.4 Compensation
You shall be entitled to receive compensation for your participation in the Flex Demand Services, as determined by Easee at its sole discretion, based on the nature, extent, and duration of your involvement. The specific terms and conditions of such compensation shall be communicated to you separately and may be subject to periodic review and adjustment.
You can request payment of your compensation at any time, provided that your participation has accrued a minimum of GBP 10. Easee will promptly consider all payment requests and pay you if compensation has accrued.
2.5 Smart Meter Access and Personal Data Processing
In connection with your participation, Easee, its Partners, Flexibility Scheme Operators, affiliates, and authorised sub-processors may collect, share, and process certain information about you and your energy usage in order to deliver the Service, register participants, calculate and verify payments, and retain settlement data in accordance with the relevant Flexibility Services program rules.
This may include:
- Contact details (including email and address)
- Installation records and records associated with commissioning
- Meter Point Administration Numbers (MPANs)
- Half-hourly metered electricity consumption and export data
- Flexible Device measurements and usage information
- Settlement calculations and related participation data
Half-hourly consumption and export data will be processed by Partners and their authorised sub-processors through the national smart meter systems in accordance with the Smart Energy Code.
Easee and its Partners may provide Flexibility Scheme Operators with aggregated half-hourly consumption, export, baseline and reduction data, and information on any incentives used for the purposes of delivering the Service. Flexibility Scheme Operators may, in some cases, request detailed half-hourly data around specific Events in order to audit performance and payment, which may include data on an individual participant basis.
By entering the Service, you agree to receive communications from Easee and/or its Partners in connection with your participation. You also agree that the above information will be processed, shared, and retained by Easee, its Partners, and authorised sub-processors for the purposes described.
The legal basis for Easee’s processing of your personal data in relation to the Flex Demand Services is the explicit consent you provide by accepting these Flex Terms. As this constitutes an additional agreement with Easee (separate from the Easee Products and Cloud Services Terms and Conditions), you may terminate this agreement and exclude your device from the Flex Demand Services at any time, without affecting your access to other Easee cloud services.
Easee is the Controller under the applicable data protection law with respect to the processing of your personal data necessary to provide the Easee Flex Demand Services. We will process such personal data in accordance with the Easee Privacy Notice.
Easee Partners acts as a Data Processer under the applicable data protection law with respect to processing of personal data necessary to provide UK Flex demand Services.
3. COMPLAINTS, CHOICE OF LAW AND DISPUTES
If you have questions relating to the Easee UK Flex demand Services or wish to make a complaint, you may contact us or using the address provided below.
These Terms shall be governed by English law. The courts of England shall have exclusive jurisdiction to settle disputes about the interpretation and/or application of these Terms.
Easee is neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.
